Comprehensive Terms & Conditions of Use and Affiliate Program Agreement

Part I: Website Terms & Service Conditions

1. Acceptance of Agreement

This document constitutes a legally binding agreement (“Agreement”) between you (“User”, “Subscriber”, “Affiliate”) and Investment Point governing your access to and use of our Website, print editions, digital dispatches, mobile applications, affiliate program, and associated services (collectively, the “Services”).

By accessing, browsing, registering for, or using our Services, you signify that you have read, understood, and agreed to be legally bound by this Agreement and our Privacy Policy. If you do not agree to these Terms, you are strictly prohibited from using the Services and must discontinue use immediately.

2. Scope & Nature of Services

Investment Point provides financial journalism, market commentary, news reports, educational content, and marketing tools across multiple channels:

  • Weekly Print Newspaper : Physical periodical Gujarati editions dispatched to registered delivery locations.

  • Daily Digital Financial Newsletter : Electronic news briefs, daily market summaries, and analysis delivered via Newa Letter, email, SocialMedia, Digital Platforms, Whats App or web applications.

  • Web Portals & Digital Archives: Online news feeds, resource libraries, public interactive features, and marketing platforms accessible via Investment Point and associated domains.

We reserve the right to modify, suspend, introduce, or discontinue any feature, service, or portal offering at our sole discretion without prior notice.

3. User Eligibility & Account Registration

  • Age & Capacity: You must be at least 18 years of age and legally competent under applicable laws to enter into a binding contract.

  • Accuracy of Data: You agree to provide current, truthful, accurate, and complete registration details (“Registration Information”) and update them promptly as necessary.

  • Credential Security: You are solely responsible for protecting your account login credentials. Any activity, transaction, or security breach originating from your account remains your legal responsibility.

  • Single User Access: Account logins may only be used by one individual; shared logins across multiple users are strictly prohibited.

4. Subscriptions, Pricing, & Delivery

  • Activation: Subscriptions become active immediately upon successful verification of payment through our designated RBI-compliant third-party gateways.

  • Print Delivery: Weekly physical editions rely on local postal and courier networks. Investment Point is not liable for dispatch delays caused by transit bottlenecks, postal strikes, force majeure events, or incorrect shipping addresses provided by the User.

  • Digital Content Delivery: Daily digital issues are dispatched directly to your registered email address. Users are responsible for configuring spam filters to ensure receipt of our domain emails.

  • Price Revisions: Subscription rates are subject to change. Any price adjustments will apply strictly to subsequent renewal terms and will not affect active billing cycles.

5. Cancellation & Refund Policy

  • Non-Refundable Subscriptions: Due to the immediate delivery of intellectual property, proprietary analysis, and initial dispatch costs, all paid subscription fees are strictly non-refundable and non-transferable once processed.

  • Damaged or Missing Print Issues: In the event of a missing or damaged physical print edition, Subscribers must notify our circulation desk within 48 hours of scheduled delivery. Replacement copies or term extensions will be issued at our discretion.

  • Duplicate Gateway Charges: Accidental double transactions resulting from technical gateway errors will be audited and refunded to the original payment source within 7–10 business days.

6. Statutory Financial Disclaimer & SEBI Regulatory Notice

  • Educational Purpose Only: All content, technical chart commentaries, stock updates, market commentaries, and analysis published across our platforms are provided strictly for educational and informational purposes.

  • No Individualized Advice: Nothing published by Investment Point constitutes an offer, solicitation, stock tip, or recommendation to buy, sell, or hold any security, derivative, mutual fund, or financial asset. Investment Point does not operate as a SEBI-registered Investment Adviser (RIA), Research Analyst (RA), or Portfolio Manager.

  • Market Risk: Securities investments are subject to market risks, including potential loss of principal. Readers must conduct independent due diligence and consult a qualified, SEBI-registered financial advisor before executing financial transactions.

  • Limitation of Financial Liability: Investment Point, its editors, analysts, and contributors disclaim all liability for direct, indirect, or consequential trading losses or lost profits arising from reliance on published materials.

7. User Conduct & Prohibited Activities

You agree not to use the Website or Services to:

  • Post or transmit defamatory, obscene, unlawful, pornographic, offensive, or infringing content.

  • Upload malicious software, viruses, Trojan horses, or harmful code designed to interrupt network functionality.

  • Engage in unauthorized commercial solicitations, spamming, automated data scraping, or bot-driven registrations.

  • Impersonate any person or entity or misrepresent your affiliation with any entity.

  • Circumvent security access controls or attempt unauthorized access to restricted subscriber or affiliate portals.

Violation of user conduct rules may result in immediate account termination, forfeiture of commissions/subscriptions, and legal action.

Part II: Affiliate Program Terms of Service

8. Affiliate Eligibility & Account Setup

  • Participation Requirement: To participate in the Investment Point / Nikhil Bhatt Affiliate Program (“Program”), you must complete the signup process, provide your legal full name and a valid email address, and meet all eligibility criteria.

  • Bot Prohibition: Accounts registered by “bots” or other automated methods are strictly prohibited.

  • One Account Rule: One person or legal entity may not maintain more than one affiliate account.

  • Self-Referral Prohibition: You may not use your affiliate links to purchase products or subscriptions for your own use or earn money on your own account. Such purchases will result in commission forfeiture and account termination.

9. Links, Graphics, & Tracking

  • Special Links: Upon signup, you will be assigned a unique Affiliate Code and special link formats (“Special Links”). You are permitted to place authorized graphics, banners, and text links containing your Affiliate Code on your website, email communications, or social channels.

  • Tracking & Commissions: Referral fees are earned only on sales occurring directly through automatically tracked Special Links routed to Investment Point. We are not liable for uncollected commissions resulting from improperly formatted links or failure to use assigned Affiliate Codes.

  • Product Pricing Display: Product prices and availability are subject to change. Affiliates should not hardcode fixed product prices on their websites to prevent misrepresentation.

10. Referral Fees, Thresholds, & Payment Terms

  • Earnings Threshold: Commission payments begin only after your accrued affiliate earnings exceed $10 USD (or equivalent in INR). If your account does not meet the $10 threshold, earnings will rollover to subsequent months until met.

  • Payment Schedule: Eligible earnings exceeding the threshold are processed monthly according to our payout schedule.

  • Disqualification: We reserve the right to disqualify and forfeit commissions earned through fraudulent, illegal, misleading, or overly aggressive sales and marketing practices.

11. Relationship of Parties & Representation

  • Independent Contractors: You and Investment Point are independent contractors. Nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative, or employment relationship.

  • No Misrepresentation: Affiliates may not issue press releases, claim to be part of Investment Point / Nikhil Bhatt, claim to develop our products, or state that we support, sponsor, or endorse any charity, cause, or external business.

12. Affiliate Program Termination

Either party may terminate participation in the Program at any time, with or without cause, by providing written notice. Upon termination:

  • You must immediately remove all Special Links, logos, trademarks, and promotional graphics from your platforms.

  • Any accrued earnings above the $20 threshold will be paid out during the standard billing cycle, provided they were not earned through fraudulent or prohibited methods.

Part III: Legal & Statutory Framework

13. Intellectual Property Rights

All content, layouts, graphic designs, logos, software scripts, and materials published on our Website, print editions, and affiliate assets are the exclusive intellectual property of Investment Point and protected under Indian and international copyright and trademark laws. Unauthorized reproduction, modification, or redistribution is strictly prohibited.

14. Statutory Media Disclosures & Compliance

  • Press Regulations: Investment Point adheres to the Press and Registration of Periodicals Act, 2023, the rules framed by the Press Registrar General of India (PRGI), and the Norms of Journalistic Conduct issued by the Press Council of India (PCI).

  • Digital Ethics Code: Digital publishing operations comply with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

15. Grievance Redressal Mechanism

In accordance with the Information Technology Act, 2000, and rules made thereunder, any grievances or statutory notices should be sent to our Compliance Officer:

16. Governing Law & Dispute Resolution

This Agreement shall be governed by, and construed in accordance with, the laws of the Republic of India. Any legal action, dispute, or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts situated in Jamnagar, Gujarat, India.
